Gary Mills and Tony Poole are two wrongly convicted Gloucester men who have served 10 years for the murder of Hensley Wiltshire, a murder they did not commit. Their case raises many questions and is a great cause for concern. Since their conviction their case has been investigated by Trial and Error and considerable evidence has been uncovered but the Intransigence of the judicial system means that after nearly 11 years they remain In prison with no prospect for release as they will not accept guilt. Mills and Poole's defence is particularly distasteful to the law and order system as the evidence they have since unearthed to show their innocence also points an accusing finger at the real murderers. Mills and Poole maintain that a further assault on Hensley took place.

THE EVENTS

Late at night at a flat in Conduit Street, Gloucester on January 5th 1989 Hensley Wiltshire, high on alcohol and amphetamine violently attacked Gary Mills on three occasions. Each time, witnessed by Tony Poole. Neville Juke, and Kimberley Stadden, Mills defended himself and over powered Wiltshire. During the fights Wiltshire drew a knife on Mills who defended himself with an iron bar. Mills arranged an ambulance for Wiltshire and left to tend to his own lesser injuries.

POOLE TAKES NO PART IN FIGHT

At no point did Poole take part in any assault on Wiltshire. He has always maintained that his only involvement was for him and Neville Juke to stop the fighting at one point. Both Mills and Neville Juke support Poole's claim.

HOSPITAL RECORD SHOWS MINOR INJURIES

Wiltshire was taken to Gloucester Royal Hospital (GRH) at 12:35am where he was treated by Dr Fletcher for minor wounds and bruises which were recorded. Gloucester Police arrived and at 4.30am arrested Wiltshire for other matters. Whilst in custody he was seen by a police doctor who said he should not be in custody and at 5.35 re admitted him to GRH. Once more he was treated by Dr Fletcher (a breach of GRH policy and guidelines) and a second record of his injuries was taken. Once more he was discharged from hospital back into police custody at 6.20am(a further breach of GRH policy). At 12:30 pm on January 6th he was rushed back to GRH but he died before he got there. At the post morterm a further 60% of previously untreated injuries were recorded. They included three broken ribs, a broken leg and clear untreated wounds to the head.

POLICE THREATS KEEP KEY DEFENCE WITNESS AWAY

Mills and Poole were largely convicted on the evidence of Kimberley Stadden and Paul White. The evidence of Neville Juke was never heard. In a phone call D. I. Trevor Gladding threatened eyewitness Neville Juke not to attend court or he would go to jail. When asked if he had done so at the trial he denied it. Juke, who would have testified that Mills acted in defence and that Poole took no part at all, had taped the call. His statements were also kept

from the defence who advised Mills and Poole not to call him as they had no idea what he would say. At Mills and Poole's appeal in 1996 D.I.Gladdings behaviour was described as reprehensible and unwise. In October 1998 a High Court found former D.I.Gladding, in effect, guilty of perverting the course of justice (threatening Juke) and perjury- The SET UP FOR LIFE campaign are calling for criminal proceedings to be taken against Mr Gladding.

WHAT OF STADDEN AND WHITE?

Paul White made his statements whilst under arrest on suspicion of arson and burglary. He claimed that from the street outside through a gap in the curtains of the flat, he saw someone striking downwards and heard someone shouting 'No Tony ' implying that Poole was attacking Wiltshire . The Trial and Error documentary clearly proves that he could not see what he claimed unless he had step ladders with him. Kimberley Stadden in her statements confessed to possession of amphetamine and that she was committing fraud with a stolen cheque book. She was never charged with any offence to the contrary it later transpired that she received regular amounts of money from Gloucester Constabulary for her services rendered.

POLICE / CPS HID STATEMENT FOR 6 YEARS

A statement by Ian Armstrong came to light 6 years after Mills and Poole were convicted. An independent witness who was in the cell next to Wiltshire, he heard screaming and someone shout 'GET OFF ME', followed by another male saying 'SHUT UP YOU BLACK BASTARD', then another said 'HES STOPPED BREATHING, GET A DOCTOR AND AMBULANCE QUICK'. We now know that for his last hours alive Hensley was being held unlawfully.
